If your application is refused
Contrary to Law, Mistake of Identity, or Exceptional Circumstances
If you have applied for an internal review on the grounds of Contrary to Law, Mistake of Identity, or Exceptional Circumstances, the following options are available to you if your application is refused:
- pay the infringement and any prescribed costs by the due date;
- where an infringement offence involves additional steps and the Council confirms the decision, you must pay the infringement and perform all the additional steps by either the end of the period specified in the infringement notice or within 14 days after you have been sent advice of the outcome of the review;
- apply to Council for a payment plan;
- elect to have the matter heard in Court (Magistrates’ or Children’s Court);
- make an application to the Director, Fines Victoria under the Family Violence Scheme (see above for further information); or
- if you are eligible, you may apply to Fines Victoria for a Work and Development Permit (WDP), which, if granted, means that you can work to pay off your fine. An application for a WDP must be made on your behalf and with your consent by a sponsor accredited under the WDP scheme. If you do not have a sponsor, you can contact the WDP team for a referral to a sponsor. Infringement fines can be included on a WDP whether or not Council registers your fine with Fines Victoria. Failure to do any of the above may result in further costs and enforcement action.
Special Circumstances
If you have applied for an internal review on the grounds of Special Circumstances, the following options are available to you if your application is refused:
- pay the infringement and any prescribed costs by the due date;
- apply for a payment plan;
- elect to have the matter heard in Court (Magistrates’ or Children’s Court, as appropriate);
- make an application to the Director, Fines Victoria under the Family Violence Scheme (see above for further information); or
- if you are eligible, you may apply to Fines Victoria for a Work and Development Permit (WDP), which, if granted, means that you can work to pay off your fine. An application for a WDP must be made on your behalf and with your consent by a sponsor accredited under the WDP scheme. Person Unaware

- where an infringement offence involves additional steps and the enforcement agency confirms the decision, pay the infringement and perform all the additional steps by either the end of the period specified in the infringement notice or within 14 days after you have been sent advice of the outcome of the review;
- apply to Council for a payment plan;
- elect to have the matter heard in Court (Magistrates’ or Children’s Court);
- make an application to the Director, Fines Victoria under the Family Violence Scheme (see above for further information); or
