Infringement notices - your options

Council issues infringement notices for various offences under legislation and Council’s local laws.

If you have received an infringement notice from Council, you can respond in one of four ways. Please click on the links below for important information regarding each of these options.

If you do not respond by the due date shown on the notice, Council will send a Penalty Reminder Notice which may include additional costs. If a Penalty Reminder Notice is not responded to, Council may refer the matter to the Magistrates’ Court, or to Fines Victoria.

Option 1 - pay an infringement notice

If you choose to pay your infringement notice, it must be paid by the due date shown on the notice otherwise the matter may be referred to the Magistrates Court or Fines Victoria.

You can pay your infringement notice in the following ways.

Please call 1300 797 363 to pay over the phone with your credit card. You will be asked to quote the infringement number.

Please send cheque or money order to:

Please detach the payment slip from the front of the infringement notice and attach it to your cheque or money order.  Alternatively, write the infringement number on the back of your cheque or money order.

Payment may be made by cash, credit or debit card, cheque, or money order at any of the following locations:

Payment can be made by transferring funds online into the following bank account:

You MUST include the infringement number in the transaction reference field. Failure to do so may result in your payment being unidentified which may result in further action being taken and/or additional costs being added.

Option 2 - request a payment plan or extension of time

If you have been served with an infringement notice, you may apply to Council for a payment plan or extension of time in which to pay the infringement penalty and any penalty reminder notice fee.

To apply for a payment plan or extension of time, please complete the Application for Payment Plan or Extension of Time for Infringement Form(PDF, 366KB).  This form must be submitted to Council by the due date shown on the infringement notice.

If a payment plan has been accepted by Council, the matter will be referred to Fines Victoria for management on Council’s behalf. More information about payment plans can be found here:

Option 3 - request an internal review

You, or a person acting on your behalf with your consent, can request an internal review of your fine.

A request for an internal review should be made to Council in writing preferably before the due date shown on the infringement notice, however, requests may be made at any time before the matter is referred to the Magistrates’ Court. The time-period for referral to Court varies for different infringement offences.

If your request for an internal review is made on the grounds that you were unaware of the infringement notice, the application must be made within 14 days of you becoming aware of the infringement notice.

A request for an internal review must include the following information:

  • Your name and residential address;
  • Your postal address or email address;
  • The infringement notice number;
  • The vehicle registration number (where applicable);
  • The grounds on which you are relying (see below) and an explanation as to why you are relying on those grounds; and,
  • Any supporting evidence or documentation.

 

Neither the Mayor nor Councillors are legally allowed to have any involvement in the internal review process.

Before you request an internal review

Option 4 - elect to have a matter heard and determined in court

If you wish to have the matter heard in the Magistrates’ Court, you must advise Council in writing. This can be done by writing a letter or downloading a Request a Court Hearing(PDF, 719KB) form, and either:

Once Council receives a written notice to have the matter heard in court, an Intention to Prosecute Notice will be sent to you. Further instructions and information will be contained in that notice.

If you elect to have the matter heard in court, please refrain from making any payments in relation to the infringement notice.
